II. GENERAL CONDITIONS OF USE

2.1 Purpose

The present conditions define the terms and conditions of access and use of the website www.espritmeuble.com (hereinafter referred to as the Website).

This Website is an informative site relating to the next ESPRITMEUBLE Trade Fair which will be held from 20 to 23 November 2021 in Paris Porte de Versailles (hereinafter referred to as the Trade Fair). The purpose of this Trade Fair, which will bring together 300 French and international brands, is to present the newest trends in terms of furniture. Free entry is reserved for professionals in the sector.

These conditions, in their latest online version, apply to any person who connects to the Website (hereinafter referred to as the Website User(s)). Any connection to the Website implies tacit and unreserved acceptance by the User(s) of the content of these conditions.

ESPRITMEUBLE reserves the right to modify unilaterally the contents of these conditions at any time. Under these conditions, the Users of the Website are therefore invited to consult them regularly in order to be aware of any changes in their content.

The Website offers to any professional wishing to visit the Trade Fair the opportunity to register as a visitor (hereinafter referred to as Trade Fair Visitors). After clicking on the tab provided for this purpose, Trade Fair Visitors are invited to fill in the form provided for this purpose. On this form, they must indicate their identity, their position, and their e-mail and electronic contact details. After validating their form, Trade Fair Visitors will receive an email confirming their participation in the Trade Fair and containing a link to download their entrance tickets.

2.3 Exhibitor personal space

All Trade Fair Exhibitors have a secure personal space. To access it, Exhibitors must enter the login followed by the password provided by the organisation. From this space, Exhibitors can manage the content of their participation file, access and download all the logistical information concerning their access to the Trade Fair, the corresponding communication tools and their participation badge. They can also order various technical services and track the corresponding orders. These orders are subject to their own terms and conditions which Exhibitors can consult from their personal space.

2.4 Accessibility

Espritmeuble undertakes to make every effort with regard to Website Visitors to guarantee them the maximum Website accessibility as well as its correct operation..

However, it cannot assure them that any malfunction affecting the Website could not occur. Malfunctions indicate any computer, technical or other difficulties arising from a case of force majeure, an event beyond the control of espritmeuble, or a failure or maintenance work on the Website.

Website Visitors acknowledge that such malfunctions may occur when connecting to the Website. In no circumstances can espritmeuble be held liable for any damage, which they may suffer from this fact, whatever their subject or nature.

Website Visitors acknowledge that they have the skills and means necessary to access and use the Website. They acknowledge that they have verified that the computer configuration they use does not contain any viruses and that it is in perfect working order.

2.5 Responsibility

Espritmeuble declines any responsibility in relation to damages of any type that may be suffered by Website Users in relation to :

the consequences of any virus, computer bug, anomaly, failure of any type affecting the Website,

the transmission, reception, loss of any data or information processed by the Website,

any malfunction of the Internet network that may prevent access to and correct operation of the Website.

Espritmeuble strives to offer Website Users the most reliable, high quality information there is on the Website without guaranteeing its accuracy and completeness. Under these conditions, it cannot be held liable for direct or indirect damage suffered by Website Users or by third parties which may be derived from the information circulated on the Website, and more generally, in the consultation and use of the Website. It is up to Users to ensure that no other person has access to the application without their authorisation.

Furthermore, espritmeuble does not provide any surveillance concerning the hypertext links connected to the Website, whether or not of its doing, and declines all responsibility for their presence and their content to which they may refer.

2.6 Personal data 

This Website includes various forms through which various personal information is collected. This information is processed electronically by espritmeuble, kept by it in a secure area and reused by its teams from one year to the next with the purpose of enabling it to carry out prospecting and commercial promotion work concerning the Trade Fair. Under no circumstances will this data be passed on to external partners.

This Website has been the subject of a prior declaration to the Commission Nationale de l'Informatique (French Data Protection Agency).

In accordance with the amended "French Data Protection Act" dated 6 January 1978, Website Users have the right to access and rectify information concerning them. The latter can access this information by sending an e-mail to contact@espritmeuble.com.

For legitimate reasons, Website Users may also object to the processing of personal data concerning them.

2.7 Intellectual property 

Espritmeuble is the exclusive owner of the entire website (graphics, images, texts, logos, formatting) with regard to international and national provisions in terms of Industrial Property Law and Trademark Law. Consequently, any total or partial representation of this website by any process whatsoever, without the express authorisation of espritmeuble is prohibited and would constitute an infringement punishable by Articles L.335-2 et seq. of the French Intellectual Property Code. Any total or partial reproduction of the brands or logos of ESPRITMEUBLE or its partners carried out using elements of the website without the express authorisation of espritmeuble or the owner of the logo or brand is prohibited according to the French Intellectual Property Code.

2.8 Litigation 

These conditions complete any other agreements that Website Visitors may have made with espritmeuble.

In the hypothesis that any provision in these Conditions would be considered invalid for any reason whatsoever, this provision would be deemed to be null and void. All other provisions of these General Conditions of Use will then remain binding.

These General Conditions of Use are governed by French law both for substantive rules and those governing their form. In the event of a dispute, the parties agree to seek an amicable solution before referring the matter to the competent court under French law.
